1. Acceptance of Terms
By accessing or using CureMeridian (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Our Privacy Policy, Cookie Policy, Medical Disclaimer, and AI Transparency notice are incorporated into these Terms by reference and form part of your agreement with us.
2. Service Description
CureMeridian is an AI-powered information and hospital-matching platform that helps users explore and compare international medical clinics and procedures. We are NOT a healthcare provider, insurer, or medical intermediary. We provide informational services only and do not arrange, facilitate, or guarantee any medical treatment.
Any cost figures we show are our own estimates for general guidance, not quotes, offers, or guarantees of price. Only a hospital can give you a binding quote for your specific case.
CureMeridian is free for patients. When you consent to be introduced to a hospital, that hospital pays CureMeridian a fee for the qualified introduction. This is how we fund the platform. We do not charge you, and being paid by hospitals never changes how our algorithm scores or ranks your matches.
3. Eligibility and Account Registration
You must be at least 18 years of age to use the Service. By registering, you represent that you are at least 18 years old and that all information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to reverse-engineer, scrape, or circumvent the Service
- Use automated tools to access the Service without authorization
- Impersonate any person or entity
- Interfere with the proper functioning of the Service
- Use the Service to harass, harm, or deceive others
5. Intellectual Property
CureMeridian's own content, including our text, software, design, the CureMeridian name and logo, and our AI-generated copy, is the property of CureMeridian and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from it without our express written permission. Some material on the Service, including many hospital, procedure, and destination photographs and hospital names and logos, belongs to third parties and is used under licence, permission, or as the law allows; that material remains the property of its respective owners.
User-submitted content (reviews, photos) remains your property. By submitting, you grant us a worldwide, royalty-free license to use, display, and distribute such content on our platform.
If you believe content on the Service infringes your copyright, you can send a takedown notice to dmca@curemeridian.com and we will respond promptly under our DMCA takedown procedure.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that information is accurate, complete, or current.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUREMERIDIAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (I) YOUR USE OF THE SERVICE; (II) ANY MEDICAL TREATMENT OBTAINED THROUGH A CLINIC FOUND VIA OUR PLATFORM; OR (III) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUREMERIDIAN'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CUREMERIDIAN IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH, FOR PATIENTS, IS USUALLY ZERO) OR (B) ONE HUNDRED US DOLLARS (US$100).
8. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CureMeridian and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party. This indemnity does not apply to the extent a loss is caused by our own breach or negligence, and it does not limit any rights you have as a consumer under mandatory law.
9. Third-Party Services and Hospitals
CureMeridian displays information about third-party clinics and links to third-party websites. We do not endorse, control, or assume responsibility for the content, practices, or services of any third party. Your interactions with third-party clinics are solely between you and those clinics.
10. Termination
We may terminate or suspend your account for violation of these Terms or fraudulent or unlawful activity. Where we suspend or terminate for other operational reasons, and except where a serious breach or legal obligation requires immediate action, we will give you reasonable notice. Nothing here limits your rights as a consumer under mandatory law. You may delete your account at any time via account settings, and data deletion follows our Privacy Policy.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, the state and federal courts located in Delaware shall have exclusive jurisdiction. Nothing in this section deprives EU/UK consumers of the protection of mandatory consumer-protection laws of their country of residence or their right to bring proceedings in their local courts. EU residents may also use the EU Online Dispute Resolution platform.
11A. Binding Arbitration and Class-Action Waiver (US users)
Please read this section carefully, it affects your legal rights. If you are a US resident, you and CureMeridian agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the US Federal Arbitration Act, rather than in court, except that either party may bring an individual claim in small-claims court. You and CureMeridian waive any right to a jury trial and to participate in a class, collective, or representative action.
You may opt out of this arbitration agreement by emailing contact@curemeridian.com within 30 days of first accepting these Terms. This section does not apply to EU/UK consumers, who retain their local-court rights described above.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or prominent in-app notice. Continued use after the effective date constitutes acceptance of the updated Terms.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
14. Force Majeure
CureMeridian shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or internet disruptions.
15. General Provisions
Entire agreement. These Terms, together with the policies incorporated by reference in Section 1, are the entire agreement between you and CureMeridian regarding the Service and supersede any prior agreements on that subject.
Assignment. You may not assign or transfer these Terms without our consent. We may assign these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets, provided your rights under these Terms are not materially reduced.
No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Survival. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination of these Terms.
EU right of withdrawal. The Service is free for patients, so the EU 14-day right of withdrawal for distance contracts does not apply to your use of CureMeridian. Any contract for medical treatment is between you and the hospital, and any withdrawal or refund rights for that treatment are a matter for that hospital.
